Unpaid Capital One Offers Lawsuit

Capital One is in the hot seat again. A new class action lawsuit alleges that the bank has been failing to pay out promised cashback rewards to its cardholders, specifically targeting those who earned rewards through the Capital One Offers program.

The lawsuit claims that Capital One marketed specific cashback percentages to entice consumers to sign up for and use their credit cards. However, many users are reporting that these rewards never hit their accounts, or were significantly less than what was advertised.

“Capital One regularly failed to provide cardholders with the payout that they had been promised in the offer after the cardholders made purchases in reliance on the offer,” the Capital One class action lawsuit alleges.

While the lawsuit is still in the early stages, it aims to represent a nationwide class of Capital One cardholders who were eligible for cashback rewards but did not receive them as promised. Right now, there is no settlement money to claim yet. This is a pending lawsuit.

But as this case moves through the court system, it could eventually lead to a settlement where eligible cardholders can file for a refund.

Lawsuit info: McNichols v. Capital One Bank N.A., et al., Case No. 1:26-cv-00145, in the U.S. District Court for the Eastern District of Virginia.
